Welcome to Cyberstorm Press. These Terms and Conditions constitute a legally binding agreement between you ("User," "you," or "your") and Cyberstorm Press, a publishing company ("Company," "we," "us," or "our"), concerning your access to and use of our website (www.cyberstormpress.com), our publishing services, and any related platforms, including digital and print publications, author submissions, and merchandise sales (collectively, "Services").

By accessing or using our Services, you agree to be bound by these Terms and Conditions.

If you do not agree, please do not use our Services.

1. Acceptance of Terms

By accessing our website, submitting content, purchasing products from Minerva Trinkets LLC or a product containing our signature, icon, name, etcetera, or engaging with our Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. We reserve the right to update or modify these terms at any time, and such changes will be effective upon posting on our website. Your continued use of the Services after changes are posted constitutes your acceptance of the revised terms.

2. Intellectual Property

All content on our website and published works, including but not limited to text, images, graphics, digital books, print books, and other materials, is owned or licensed by Cyberstorm Press or its affiliates. You may not copy, reproduce, distribute, modify, publish, or create derivative works from our content without express written permission from Cyberstorm Press, except as permitted for personal, non-commercial use under applicable copyright laws.

2.1 Author Submissions

If you submit manuscripts, artwork, or other creative materials ("Submissions") to Cyberstorm Press, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to review, evaluate, and potentially publish your Submissions. You warrant that your Submissions are original, do not infringe on third-party rights (We will find out), and that you have the authority to grant such a license. Cyberstorm Press reserves the right to reject any Submission at its sole discretion without liability.

2.2 Published Works

Upon acceptance of your Submission for publication, additional agreements will govern the rights, royalties, and obligations related to your work. Unless otherwise specified in a separate publishing agreement, Cyberstorm Press retains the right to publish, distribute, and market accepted works in any format (e.g., print, digital, audio) worldwide. Cyberstorm Press does take a 35% cut of all profits.

3. User Conduct

You agree to use our Services in compliance with all applicable laws and these Terms. You may not:

Use our Services for any unlawful or unauthorized purpose.
Submit, post, or share content that is defamatory, offensive, or infringes on the rights of others, including intellectual property rights.
Attempt to interfere with the operation of our website or Services, including through hacking, data mining, or introducing malicious code.
Use our Services to engage in unauthorized advertising or marketing.
Submit literature or works with any hatred towards real-life groups, nations, or races (Subject for immediate refusal and blacklisting).

Cyberstorm Press reserves the right to terminate or restrict your access to our Services without notice if you violate these terms.

4. Purchases and Payment Terms

4.1 Product Sales

Our Services include the sale of digital books, merchandise, and other products. All prices are listed in USD and are subject to change without notice. By placing an order, you agree to pay the total amount, including applicable taxes and shipping fees, as displayed at checkout.

4.2 Refunds and Returns

Physical products are subject to the Return clause of Minerva Trinkets LLC "Item or items must be returned within 30 days of the purchase date with a sales receipt. All items must be returned in the original condition with packaging." Digital products are non-refundable.

4.3 Subscriptions

Cyberstorm Press only has a newsletter, which is a free sign-up to receive.

5. User-Generated Content

If our Services allow you to post or submit content (e.g., reviews, comments, or forum posts), you grant Cyberstorm Press a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and distribute such content in connection with our Services. You are solely responsible for ensuring your content complies with these Terms and does not infringe on third-party rights. We reserve the right to remove or moderate user-generated content at our discretion without notice.

6. Copyright Infringement (DMCA Compliance)

Cyberstorm Press complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted material has been used on our website or Services without permission, please send a written notice to our designated Copyright Agent at:

Your notice must include:

Identification of the copyrighted work claimed to have been infringed.
Identification of the material claimed to be infringing, including its location on our website.
Your contact information.

A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

We will respond to valid DMCA notices and may remove or disable access to the allegedly infringing material. Counter-notifications may be submitted as per DMCA requirements.

7. Limitation of Liability

To the fullest extent permitted by law, Cyberstorm Press, its affiliates, admins, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of data, profits, or business opportunities. Our liability for direct damages shall be limited to the amount you paid for the specific Service or product giving rise to the claim. Our Services are provided "as is" and "as available," without warranties of any kind, express or implied.

8. Disclaimer of Warranties

Cyberstorm Press does not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of our Services without notice. Product descriptions, pricing, and availability are subject to change without notice, and we are not liable for inaccuracies or errors in such information.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Pennsylvania, United States, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be settled by the author's submission being immediately removed from both Cyberstorm Press and Minerva Trinkets LLC, and the writer will then be blacklisted from both.

10. Termination

We may terminate or suspend your access to our Services at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users, Cyberstorm Press, or third parties. Upon termination, your right to access our Services will cease immediately.

11. Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue our Services, or any part thereof, at any time without notice. We are not liable for any loss or damage resulting from such modifications or interruptions.

13. Miscellaneous

Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with any supplemental agreements (e.g., publishing contracts), constitute the entire agreement between you and Cyberstorm Press.
No Waiver: Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision.
Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign our rights and obligations at our discretion.

By using our Services, you acknowledge that you have read and agree to these Terms and Conditions. Thank you for choosing Cyberstorm Press.

Cyberstorm Press is non-disclosure for all authors, poets, writers, etcetera. If you do not wish to make public appearances, then we will not disclose that information (An NDA form will be provided upon approval of materials and/or items). All you need is a name, or an alias, to write under. If you are comfortable with public appearances, we can make arrangements sometimes. All authors can decide to autograph their works, but this is only possible at in-person events or meetings with a Minerva Trinkets LLC member.

Note that blacklisted individuals will not be permitted to associate with Minerva Trinkets LLC or Cyberstorm Press upon acknowledgement by both organizations. Individuals who violate Terms and Conditions or disputes escalate from negotiations failing. If you dispute Cyberstorm Press or Minerva Trinkets LLC, your submissions will all be pulled from our services, and you will be added to the blacklist, unable to continue associating with either organization.
